Judge Ratha Mokgoatlheng has ruled that Bongani Ntanzi ‘s rights were infringed when an audio recording was made of him confessing to his role in the murder of former Bafana Bafana captain Senzo Meyiwa.

The ruling comes on the back of the State’s application to have the recording admitted as evidence even though Ntanzi did not know that he was recorded.

“In this case, I am of the view that accused number two’s rights to a fair trial were infringed by the making of the audio recording by Magistrate [Vivian] Cronje,” Mokgoatlheng said.

He said the making of the recording was an egregious abuse of Ntanzi’s rights and as such, it was inadmissible.
