Bauchi State High Court seven has granted an interim order restraining Babayo Misau from parading himself as the substantive chairman of the All Progressives Congress (APC) in the state pending the hearing and determination of a Motion on Notice.
The granted order, arising from a legal action between APC Concerned Citizens and Babayo Misau, alleged that Misau breached party regulations and worked contrary to the party’s achievements in the recent state governorship election.
The suit No/BA/07/992/2023 is between plaintiffs, APC Concerned Citizens, and defendant Babayo Misau.
Counsel to the plaintiffs, Isa Mohammed filed a motion vide writ of summons alleging that Babayo contravened the laws of the party and acted against the victory of the party at the 2023 governorship election in the state.
The counsel informed the court that the chairman’s actions went against the party constitution, asserting that his conduct contributed to the failure of the party in the election.
Isa said it is in the interest of justice to grant this application to avoid any form of chaos from the aggrieved members.
He asked the court to restrain the APC Chairman from parading himself as the chairman of the party pending the determination of the substantive suit.
In response, the court presided over by Justice Lamido Kabir Umar granted the order restraining Babayo from parading himself as the State chairman.
He ordered the parties to fast-track their case, also directing the parties to expedite their case within 14 days.
The return date for the motion on notice hearing is set for December 11, 2023.
DAILY POST recalls that the party had in April expelled Misau over accusations of allegedly engaging in anti-party activities before and during the general elections in a way that undermined the success of the party at the just concluded polls.
